BOUNDLESS LIFE TERMS AND CONDITIONS  
These terms and conditions along with the Code of Conduct and any other documents that may be signed (collectively the “Terms”) form a binding legal agreement between you (“The Client”), along with your spouse or partner, children or any other person included by them in the booking (“all of them “the Family Members”) and Boundless Hospitality Corp. (“Boundless Life”, “Boundless”) and its subsidiaries that govern our services and your use of the websites, applications, accommodations, Coworking Hubs, Education Centres, and all other offerings from Boundless Life (“Products & Services”). 

These Terms supersede all previous terms. At Boundless Life’s sole discretion, Boundless Life may at any time amend, modify or supplement these Terms. The version in force at the time of the purchase of the Product&Services shall apply. 

Family Members' participation in Boundless Life will be governed by these Terms and it is your responsibility to read and understand all of them and you acknowledge to have done so.Unless otherwise specified, all references to “days” in these Terms shall mean calendar days.

By purchasing any of our Products & Services, you are: 
(a) certifying that you are of legal age with full authority to enter into this agreement and accept and agree to respect these Terms; 
(b) certifying that you have read, understand and accept these Terms as well also accept our Privacy Policy (https://www.boundless.life/privacy-policy) and, 
(c) agreeing that these Terms constitute a binding agreement governing your relationship between the Family Members and Boundless Life. The Client acknowledges and agrees that by signing these Terms, they are acting on their own behalf and on behalf of the other Family Members. The obligations, commitments, and responsibilities arising from these Terms shall be binding upon all Family Members, regardless of whether they have individually signed this document. Boundless Life reserves the right to hold all Family Members jointly and severally liable for any obligations or liabilities arising under the Terms.The Client acknowledges and agrees that certain documentation related to the Educational Center and services in which their child is enrolled may require the signatures of both spouses or all individuals holding parental authority over the child/children.

1.- PRODUCTS AND SERVICES

Boundless Life programs (“Programs” or “Cohorts”) include home accommodation ("Boundless Homes"), Boundless Life’s services to support the Family Members during the stay (“Boundless Services Enrollment”) comprising access to Coworking Space ("Boundless Community Hubb") and "Boundless Education" The Programs do not include flights to and from the destination, permits & visas, insurance, meals and transportation during the Cohort stay, extracurricular activities, or additional paid experiences provided by Boundless Life or third-party providers. The Client, as well as the rest of the Family members  shall legally be able to travel to the Boundless location and stay for the full Cohort. The Client acknowledges and agrees that they are solely responsible for obtaining and ensuring the validity of any required visas, passports, work permits, or any other government documents necessary for their stay. The Client understands that failure to obtain the necessary government documents may result in travel delays, denial of entry into certain countries, or other adverse consequences. Boundless Life shall not be held responsible for any consequences arising from the Client's failure to obtain the required government documents. Any costs, fines, or expenses incurred due to inadequate or missing documentation shall be the sole responsibility of the Client.

The Client agrees to keep abreast of and comply with the entry requirements of the destination country or countries and shall promptly inform Boundless Life of any changes in their travel plans or circumstances that may affect their ability to obtain the necessary government documents.

The Company is solely responsible for providing the Product and Services according to the Terms and shall bear no liability with any matters beyond this scope.

Boundless Life is aimed at families with children aged  eighteen (18) months to fourteen (14) years old. The Educational Program is designed for children within those age ranges.

2.- PURCHASE OF COHORTS AND PAYMENTS

When you book a Cohort (“Booking”), you are purchasing a Cohort.

2.1. three-week and four-week Cohorts (“Getaways”): The full price is payable upon Booking.

2.2. three-month Cohorts: The price will be divided and paid in three instalmentsThe first instalment is payable upon Booking. The second instalment will be auto-charged via a third-party payment processor 120 days prior to your check-in date and the final month will be auto-charged 90 days prior to your check-in date. The same logic applies if you combine several 3-month Cohorts.

2.3. Payments: When you make a Booking, we preauthorize your credit card and charge the payment/s according to sections 2.1 and 2.2. 

For the three-month Cohorts, you authorize Boundless Life to process the scheduled payments automatically on the defined dates using the payment method on file. If a scheduled payment fails, we will notify you and may attempt to reprocess the transaction.Payments on our platform are processed securely through third-party providers. Boundless Life does not store full credit card details, but we may retain transaction information such as the last four digits of your card and transaction history for verification and support purposes. All payment data is handled according to industry security standards. 

For further information, please refer to Privacy policy. Except as provided in this Terms, the Client acknowledges that the payments are automated and non-refundable, and no further authorization is required for the scheduled charges. If a scheduled payment fails, Boundless Life will notify the Client and may attempt to reprocess the transaction. If the issue is not resolved within a specified period, Boundless Life reserves the right to charge additional fees or cancel the booking, and the Client may forfeit any payments made.

3.- CANCELLATION AND BOOKING CHANGE

3.1.- Cancellation: Once a Cohort Booking has been made, cancellation will not be accepted. All payments made prior to the cancellation are non-refundable except as provided under the Premium Protection Plan described in section 4.

3.2. Booking Change: Subject to availability at time of the request, You may request to change your Booking (either the location, accommodation or timeline), provided you initiate a change at least 120 days before the start date of your originally chosen cohort subject to the following conditions:

3.2.1. Change of cohort:
- The Client must commit to a new Cohort at the time of the change request. The newly selected Cohort must have a start date no later than nine months after the start of the originally contracted Cohort. 
- Only one Booking Change is permitted provided that it is made in accordance with the period previously indicated. 
- Payments made for the original chosen Cohort will be applied toward the payment of the newly selected Cohort.
- If the new Cohort costs more than the original chosen cohort, you will need to pay the difference according to section 3.2.3.

3.2.2. Change of accommodation: Should the Client request a change of accommodation within the same Cohort, such change will be accepted subject to availability, and the Client shall pay any price difference applicable at the time the change is requested. Only one change of accommodation is permitted.

3.2.3 Price differences: No price difference will be refunded if the Booking Change results in a lower price than originally contracted.

Should the Change of Booking involve a higher price than initially agreed, the price difference shall be applied to the remaining instalments, which will be adjusted proportionally, unless the change occurs less than 90 days before the start of the Cohort, in which case the difference must be paid at the time of the change.

Less than one hundred and twenty (120) days before the Cohort start date: no Booking Changes will be accepted under any circumstances.

4. PROTECTION PLAN

At Booking the Cohort, you have the option to select a protection plan which grants you flexibility for Booking Changes under certain conditions.The cost of the Protection Plan will  be displayed before you complete the Booking, allowing you the option to include it in the final price should you wish to obtain it.

A. Standard Protection Plan
This plan provides basic protection for Clients who need to transfer their Booking to a different Cohort due to the specific Covered Reasons (as defined below). Under the Standard Plan any eligible amounts paid will be preserved as credit to be used for the purchase of a new Cohort subject to the following conditions:

Covered Reasons:
• Medical illness or injury of a Family Member (must be supported by a signed doctor’s note).
• Job loss or change in employment of the Client and/or spouse -partner that no longer allows for remote work (written proof from the employer required).
• Bereavement (death of a Family Member) 
• Legal obligations such as jury duty or court summons (proof required).

Transferable credit: ninety per cent (90%) of the price paid for the Cohort as of that date is converted into a Transferable Credit that can be applied toward a future Booking within twenty-four (24) months as of the date of the request for Protection Plan coverage (“Transferable Credit Validity Period”). If the Boundless Life credit is not used within the Transferable Credit Validity Period, the amount will be forfeited, and the Client will not be able to request a refund. Request Deadline: The request will only be accepted up to ninety (90) days prior to the Cohort’s start date.

B. Premium Protection Plan
This protection plan provides comprehensive protection for Clients seeking maximum flexibility and coverage. This allows for extended Booking Change reasons and Deadline Request, shorter notice periods and reimbursement options. 

Covered Reasons: All covered reasons listed in the Standard Protection Plan plus the following covered reasons:
• Personal or Family Emergency (must provide proof of emergency). A family emergency shall mean an unforeseen and urgent situation involving the health, safety, or well-being of a Family Member. This may include serious illness, injury, or death requiring the Client’s immediate attention and potentially preventing or interrupting their travel plans.
• Government-issued travel advisories 
• Severe Weather impacting the home country of the Client or the Boundless Home destination. Severe Weather shall mean extraordinary and extreme meteorological phenomena which are not typical for the geographic location and season at the time of occurrence, including but not limited to storms, floods, heatwaves, snowfalls, or similar events. To qualify as Severe Weather under these Terms, the event must significantly disrupt or prevent the provision or enjoyment of the Cohort and be reasonably unforeseeable at the time of Booking.

The assessment of whether weather conditions qualify as “Severe Weather” shall take into account local historical weather patterns and seasonal norms.

Where the occurrence of Severe Weather materially prevents or makes it unsafe or impracticable the stay in the Cohort, such event may be considered a Force Majeure Event, in accordance with section 15.

Transferable Credit or Cash Refund: At Client’s option: seventy per cent (70%) Cash Refund of the amounts paid for the  Cohort at the time of the request for protection plan coverage OR one hundred per cent (100%) Transferable Credit for a future Cohort to be used within twenty-four (24) months as of the date of the request for Protection Plan coverage (“Transferable Credit Validity Period”). If the Transferable Credit is not used within the Transferable Credit Validity Period, the amount will be forfeited, and the Client will not be able to request a refund. The Client shall communicate their decision upon requesting the Protection Plan coverage. 

Request Deadline: The request will only be accepted up to sixty (60) days prior to the cohort’s start date.

5. NOTICE OF EARLY DEPARTURE

Advanced planning is required for Boundless Life to be able to provide the Client with a great experience in terms of transition logistics, accommodation allocation, and execution of events. Should the Client decide to leave the Cohort before its completion, the Client acknowledges that in so doing, he/she will forfeit the full payment. They must notify their local Community Lead as much advance notice as possible. No refunds will be made for the price paid for the Cohort, and the Client must settle in full any outstanding amounts owed to Boundless Life or third-party providers for any reason, including ECA’s, activities and experiences prior to their departure. In leaving a Cohort early, the Client forfeits access to anything Boundless Life related for the remainder of the Cohort. The Client will also be removed from the Boundless Community channels that Boundless Life uses to communicate and coordinate with Cohort Families.  

6. CANCELLATION BY BOUNDLESS LIFE, DELAYS & INTERRUPTION POLICY

6.1. Cancellations prior to the start of the Cohort: Boundless Life reserves the right to cancel any Cohort that has not yet started due to inadequate enrollment or any other reason that results in the Cohort being economically infeasible to operate, or due to good-faith concerns with respect to health, safety and welfare of the families. In the case of said cancellation, for reasons outside Force Majeure, Boundless Life will refund the amounts of the  price paid by the Client as well as up to €500 for already-made expenditures for flight travel to the  Cohort. Said refund will be paid up to 60 days after the decision to cancel the Cohort. For cancellations due to Force Majeure situations, the Client will be able to reschedule their  Cohort if possible.

6.2. Cancellations in Progress: Boundless Life also reserves the right to cancel any Cohort in progress because of good-faith concerns with respect to the safety, health, or welfare of the Client. Should Boundless Life cancel a Cohort in progress, the Client will receive a prorated credit for future  Cohorts. Except as outlined above when Boundless Life cancels a Cohort in progress, Boundless Life bears no responsibility for any expenses, including any non-refundable expenses incurred by the Client.

6.3. Cohort Delays: Boundless Life reserves the right to delay the commencement of a Cohort for reasons including, but not limited to, travel and/or quarantine restrictions, health and safety concerns, the closure of restaurants and other businesses due to lockdown restrictions and other similar events. In such an event, Boundless Life shall contact the Client regarding the alternative start dates. In the event of an overbooking due to capacity constraints caused by Boundless Life or to the Client being unable to participate on the alternative dates provided; the Client will be notified and offered an alternative Cohort schedule and/or location. Should the Client refuse the alternative Cohort possibilities offered, the Client can choose either to receive a refund of the amounts paid to date or keep them as a credit for future Bookings.

6.4.  Cohort Interruptions: Under certain circumstances, Boundless Life may need to interrupt a current Cohort due to force majeure events, safety concerns or similar events. Should the above occur, no refund of the price of the Cohort shall be made. Boundless Life will use reasonable efforts to mitigate the impact of such interruption, you will be responsible for all additional costs associated with the interruption, including, without limitation, any additional travel, accommodation and food and beverage costs although you may be able to seek reimbursement for some of these costs from any travel insurance policies you may have obtained.

7. ASSUMPTION OF RISK
The Client acknowledges that many experiences and activities carry inherent risks (including, but not limited to: slips, trips, falls; indoor and outdoor activities; native insects and wildlife, recreational equipment operation; risk of infection from COVID-19 or its variants, or any other risks not stated) and agree that, to the maximum extent permitted by applicable law, the Client assumes the entire risk arising out of the Client’s stay at the Cohort including but not limited the use of Boundless Home, Community Hub and Boundless Education Centre. The Client agrees to take precautionary measures to reduce risks and prevent accident, injury or property damage, abide by any reasonable rules posted at the Boundless Home, and to inform anyone joining the Client at the Boundless Home of these Terms.Boundless Life shall not be responsible for interruptions that may impede your use of Boundless Life Products and Services that are beyond the control of Boundless Life, such as, but not limited to: force majeure events, construction noise, inclement weather, electricity, water or Internet outages, theft, allergies, or noise violations.  Boundless Life shall not be responsible for death, personal injury or loss of any kind, no matter the cause, which are incurred by you, your pets, or anyone who is on the premises of the Boundless Home.

8. INSURANCE
The Client is solely responsible for obtaining any travel insurance, health insurance, or other types of insurance which may be needed during your stay and any activities the Client partakes in whether organised by Boundless Life or one of its third-party providers. Boundless Life is not responsible nor liable for any costs incurred by the Client related to the Client’s stay, including without limitation, costs related to travel cancellation, rebooking fees, loss of property, or medical or health issues.

9. ACCOMMODATION. BOUNDLESS HOME

9.1. Check in: Check-in is at 11am as of the first day of the Cohort. We do our best to make your booked Boundless Home available as early as possible but cannot guarantee a check-in time prior to 3pm (specific to the applicable location time-zone) on the date of your arrival. Please share the date and time you are arriving with the Boundless Life Crew for us to best plan for your arrival. 

9.2. Check-out: Check-out is up to 2pm on the last of the Cohort. Should you require a later check out time please contact the local Boundless Life Crew to see what is possible. 

9.3. Early Check-in & Late Check-out: Generally speaking Cohort specific arrival and departure days will apply. Should you wish to arrive ahead of the official check in period or check in time or wish to stay on longer or beyond the check out time on the day of check out, get in contact via community@boundless.life so we can review your request. Additional fees apply.

9.4. Your responsibility: At all times, the Client is responsible for the Client’s own acts and omissions, including the other Family members, and the Client is also responsible for the acts and omissions of anyone the Client invites to join or provide access to in any Boundless Home or any other service provided by Boundless Life. For example, this means the Client: (i) is responsible for leaving the Boundless Home (and related personal property) in the condition it was in when the Client arrived, and (ii) act with integrity, treat others with respect and always comply with Boundless Life’s policies and applicable laws & regulations.

9.5. Damage: The Client acknowledges sole responsibility for any damages incurred to the Boundless Home during their stay. Boundless Life reserves the right to invoice for damages or any additional fees incurred by Boundless Life . Boundless Life holds the authority to adjudicate damage claims. Notification of damages and associated costs will be provided within seven (7) business days of the Client's departure or at the moment of verifying the damage if aware of it before departure. Failure to settle invoices may result in the Client's ineligibility for future Cohorts.

9.6. Maintenance 
Boundless Home Access: For all maintenance which refers to significant repairs or upkeep tasks necessary to maintain the habitability, safety, and functionality of the Boundless Home, which are beyond the control and responsibility of the Client, the Client agrees to provide access to the Boundless Home as required. These could include repairs or replacements of essential systems such as plumbing, heating, ventilation, and air conditioning (HVAC), electrical systems, structural components, or major appliances provided by Boundless Life. 

Boundless Home Issues: For issues caused by the Client (such as but is not limited to; blocked drains, broken domestic appliances, broken glass, key stuck in door etc.), the Client agrees to provide access to the Boundless Home as required and pay all applicable fees for said maintenance. With respect to any lost keys, you agree to pay a “key loss” fee of 100€.

9.7. Inventory of fixtures  
Upon arrival at the Boundless Home, an inventory is available; it should be checked and approved by the Client. In case of inconsistencies, please contact the local crew immediately. Should Boundless Life not receive any communication within 7 hours of check-in at the Boundless Home, the inventory will be deemed as compliant and accepted with no reservation by the Client.

The Client is responsible for the care and safekeeping of all inventory items provided by Boundless Life during their stay. In the event that an item is lost, the Client understands and agrees to be charged for the replacement cost of the item.

9.8. Towels and Linen
The Boundless Home will be fully ready upon arrival. This includes your beds being prepared with linen and bedding appropriate for the location of the Boundless Home and season. Bath towels and hand towels are equally available to cater for your  needs. Towels and linen will be renewed during the weekly cleaning service. More frequent renewals can be arranged at an extra cost.

9.9. Cleaning
A housekeeping team will be in place to clean the Boundless Home once a week. This includes vacuuming, renewing the towels and linen and cleaning the bathroom. More frequent cleaning can be arranged at an extra cost. Additionally, it is your responsibility to remove garbage. When checking-out, please make sure the Boundless Home is not dirty beyond normal use. The dishwasher should be empty with dishes cleaned and put away. In case the Boundless Home is not left in the condition as found upon arrival, a discretionary “cleaning service” fee can be charged to the Client. The Client agrees that Boundless Life shall be the final arbiter regarding any “cleaning service” fee. Please note that unwanted items left in the Boundless Home will incur a removal fee of €150. Additional charges may apply for excessive amounts of equipment left behind.

9.10. Pets
Boundless Life has a pet friendly policy, pending local availability. Where a pet is permitted, all evidence of pet occupation must be removed from the Boundless Home and grounds at the end of the booking period. An additional cleaning fee of €250 per pet will be applied upon booking. Should damages arise within the Boundless Home during your stay, an additional damage fee will be charged.

9. 11. Non-smoking policy & prohibition of illegal acts 
Smoking of tobacco, cannabis, or any other substances, as well as vaping, is strictly forbidden within the Boundless Home. In addition, the Client agrees not to engage in any illegal activities, including but not limited to the use, possession, or distribution of illicit drugs or any other substances prohibited by law, within the Boundless Home.Should evidence arise of smoking or engaging in illegal activities inside the Boundless Home, the Client agrees to incur the cost of i) deep cleaning and ii) any additional items required to restore the Boundless Home to its original state. Boundless Life reserves the right to take appropriate legal action and terminate this agreement and the Terms with immediate effect if the Client is found to be in violation of this non-smoking policy and prohibition of illegal acts. No refund will be provided.

9.12. Internet/Wifi
Access to Internet/Wi-Fi is included and complimentary during the stay at the Boundless Home. Boundless Life will not be liable for any interruption of service caused by the internet provider or any other cause beyond its control. No refund and no discount will be granted in case of unavailability of the network access. The Client is responsible for any additional Internet charges incurred as a result of your Internet usage.

9.13. Utilities usage and charges
Utilities costs are included with certain provisions regarding usage limits. Such limits shall be properly communicated to you.

Boundless Life reserves the right to assess additional charges for excessive utilities usage. Should the Client exceed normal utilities usage, Boundless Life may apply a surcharge fee. The determination of excessive usage will be made by Boundless Life based on standard consumption levels. Any additional charges will be communicated to the Client accordingly.

9.14. Use of Boundless Home 
The Boundless Home mentioned throughout these Terms are exclusively used for Boundless Life Cohorts and for the Client’s personal use only. They cannot be sublet or offered to a separate family or any third-party. The Client acknowledges that their use does not constitute permanent residence.

9.15. Personal Property
Client is solely responsible for any items which you bring to the Boundless Home. Boundless Life shall not be responsible for any damage, loss, or theft of any items which you bring or cause to be brought to the Boundless Home.

9.16. Good Faith 
All Boundless Homes are managed or previously screened by Boundless Life. The advertising descriptions are written in good faith. For any complaint about the Boundless Home, you must inform the Boundless Life local Crew within 24 hours of check-in. The Client agrees to act reasonably and collaborate with Boundless Life to solve any issue with the Boundless Home. Boundless Life reserves the right to reallocate another rental similar to the Boundless Home if available.

10. BOUNDLESS COMMUNITY HUB

10.1. Usage of the Hub: With the purchase of the Cohort, access to the Community Hub (the “Hub”) is included for the duration of the stay. The Hub can be used as a coworking space as well as a space for community engagement, with approval from Boundless Life as further detailed in the Code of Conduct. For more information on the usage of the Hub, please refer to the Code of Conduct document.

‍‍10.2. Damage: The Client shall be solely responsible for any and all damages caused by the Client to the Hub during the period of your stay. The Client agrees that Boundless Life shall be entitled to charge for damages occurred during Client’s stay. You agree that Boundless Life shall be the final arbiter regarding any damage claims. Upon damages found, these will be communicated to the Client with the costing involved and detailed.

‍‍10.3. Pets: Pets are not allowed in the common areas, such as the Hub, due to potential risk of allergies for others.

‍‍10.4. ‍Non-smoking policy & prohibition of illegal acts Smoking of tobacco, cannabis, or any other substances, as well as vaping, is strictly forbidden within the Hub. In addition, the Client agrees not to engage in any illegal activities, including but not limited to the use, possession, or distribution of illicit drugs or any other substances prohibited by law, within the Hub.Should evidence arise of smoking or engaging in illegal activities inside the Hub, the Client agrees to incur the cost of i) deep cleaning and ii) any additional items required to restore the Hub. Boundless Life reserves the right to take appropriate legal action and terminate this agreement and the Terms with immediate effect if the Client is found to be in violation of this non-smoking policy and prohibition of illegal acts. No refund will be provided.

11. BOUNDLESS LIFE EDUCATION 

11.1. The Client acknowledges and agrees that they have been informed of the terms of Boundless' Educational services which have been provided through informational sessions and website information.  Boundless Life provides non-formal educational services to children aged between eighteen (18) months to 14 years old. Boundless Education activities are exclusively for enrolled children, and attendance will be limited to the enrolled children.

11.2. The Client must enroll at least one child to Boundless Education for the duration of the stay. 

11.3. Admissions& Confidentiality 
i. Entry to Boundless Education: The Client agrees to fully disclose all relevant information as may be requested by Boundless Life to apply for their child’s admission including but not limited to citizenship, learning needs, educational history and family circumstances of the student.

ii. Physical Contact: The parents give their consent to such physical contact as may accord with good practice and be appropriate and proper for teaching and instruction and for providing comfort to a student in distress or to maintain safety and good order, or in connection with the student’s health and welfare.

iii. Disclosures: Parents must, as soon as possible, disclose to Boundless Life in confidence any known medical condition, health problem or allergy affecting the student, any history or diagnosis of a learning difficulty on the part of the student or any member of his/her immediate family, or any family circumstances or court order which may affect the student’s welfare, safety or security and/or any precautionary measures required to ensure the same.

iv. Confidentiality & Data Protection: The Parents, on behalf of themselves and the children/child, consent to the collection, use, storage, and disclosure of personal and confidential information by the Education Centre, its officers, and staff, only to the extent necessary for the safety, welfare, and legitimate educational interests of the children and others.

The Education Centre commits to:
1. Processing personal data lawfully, fairly, and transparently, in compliance with applicable data protection laws.
2. Limiting data collection and usage to the specific purposes outlined in this agreement or as required by law.
3. Ensuring secure handling and storage of confidential information to prevent unauthorized access, disclosure, or misuse.
4. Providing access and correction rights to Parents and students, in accordance with applicable privacy laws.
5. Not sharing personal data with third parties, except where legally required, necessary for safety, or with explicit consent.For more details on how we handle personal data, please refer to our Privacy Policy.

11.4. Boundless Education’s Intellectual Property: Boundless Education and its content, features and functionality are and will remain the exclusive property of Boundless Life and its licensors. Boundless Education is protected by copyright, trademark, and other laws of all countries where our Education Centres are in operation. Families and members of the Boundless community may not sell, licence, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from Boundless Life without the prior written consent of Boundless Life.

Distribution of information: The Client agrees not to copy or distribute content included in Boundless Education’s course of activities (including postings on online forums, messages on any channel, curriculum materials, photos or documentation from in-person trips and experiences) without explicit permission of the content owner or Boundless Life.

11.5. Field trips
Should a parent like to join their children for the field trip, they need to organise their own transport, admission cost and inform the Education Centre in advance as stated below.Some venues will not have food establishments and parents may need to take food and drink with them.

Depending on the location of the field trip, there might be a limit on the number of parents that can be accommodated on the transportation or in an activity. Attendance will be on a first come, first served basis and Boundless Education staff should be notified by email no later than the Monday morning before the field trip.

Transport: Parents consent to their child/children travelling to and from the Education Centre, for Boundless Life-organised activities and events, by any form of public transport and/or in a motor vehicle driven by a responsible adult who is duly licensed and insured to drive a vehicle of that type.11.6. Extra Curricular Activities (“ECA’s) 

11.6.1. ECA’s, are offered after the normal operating hours of Boundless Education either at the Education Centre or  third-party provider’s premises.ECAs are at an extra cost that varies based on the activity, the location and time of year. Further details will be provided to the Client prior to the commencement of their Cohort.Section 13 shall apply to cancellation/refund requests for ECA’s.

12. CODE OF CONDUCT COMPLIANCE

The Client will at all times comply with the Boundless Life Code of Conduct, as amended by Boundless Life from time to time, available on Boundless Life’s public website www.boundless.life and accepted when purchasing a Boundless’ Product&Services.

13. BOUNDLESS ACTIVITIES & ECA’S AND OTHER EXPERIENCES

13.1. Boundless Life may offer activities such as wellness activities, classes (photography, language..) or excursions.The activities may be organized directly by Boundless Life or Boundless Life will provide the Client with information about potential activities that may be of interest but which are managed and organized by third-party providers independent of Boundless Life. In such cases, Boundless Life will not be held liable for the activities.

13.2 Event registration deadlines
All sign-ups for events or services must be completed at least 2 (two) weeks in advance to allow for proper coordination and organisation. This ensures we can confirm bookings, process payments, and guarantee availability. In some cases exceptions can happen based on the third parties' providers' availability.

13.3 Cancellation & Refund policy
i. Experiences
A. Refunds: The Client  may receive a full refund for an experience if the cancellation request is submitted up to two (2) weeks prior to the event, provided that the minimum number of participants required for the activity or experience is still maintained. However, for cancellation requests received less than two (2) weeks before the event, refunds will be subject to each activity and experience, and whether the minimum level of participants is secured with the remaining participants. These are the overall conditions unless stated otherwise within the details of the activity or experience. There may be specific activities or experiences that have different refund policies due to their unique nature. Please note that experiences that  include overnight stays are non-refundable. 

Refunds (Getaways): No refunds for ECAs are available during our Getaways.

B. Cancellations: If the activity or ECA is cancelled by Boundless Life or the third-party provider due to unforeseen circumstances, the Client will be offered a rescheduled date or a full refund, based on their preference and/or availability.

ii. Activities and ECAs:
A. Refunds (3-Month Experiences): Clients may receive a refund if a cancellation request is submitted up until the end of the initial business week in which the Activity or ECA has started. As an example, a refund should be requested by the end of business on that Friday of the week the ECA was first taken. Given that a first session was attended, a one-off cost will be deducted from the refund. Refunds requested after this point, will not be available.

B. Cancellations: If an activity or ECA is cancelled by Boundless Life due to unforeseen circumstances, the Client will be offered a rescheduled date or a full refund, depending on availability.

iii. Payment Processing Processing Fee: Refunds will be processed using the original payment method and may take a certain period of time to be reflected in the Client's account, depending on the payment provider. A 10% processing fee (10% of the total reimbursed amount) will be deducted from the total refund amount for any cancellation or refund request made from the Client side and as approved by the local team. Experiences, ECA’s and Activities canceled by Boundless Life will not be subject to such processing fee.

Additional Services Fees: Additional services contracted by the Client are invoiced immediately or added to the next month's invoice, payable upon receipt or within the monthly invoicing terms.

Overdue Amounts: Any overdue amounts 15 days after the invoice due date will incur a late payment charge of 5%. Failure to settle the outstanding payment within the invoiced month may affect the Client’s financial standing. Failure to pay for experiences, ECA's and other activities will prevent the Client from continuing to participate in such activities or enrolling in future ones until all outstanding payments have been settled. Boundless Life reserves the right to terminate the Client’s occupancy after two (2) payment reminders due to non-payment.

13.4  Risk of the ECA’s, activities and experiencesWhen enrolling in an activity or experience, or when registering their child for any ECA, the Client acknowledges and accepts responsibility for their participation . They are required to comply with the instructions provided by the organiser to ensure their safety and the smooth operation of the activity. Participants should promptly report any issues or concerns they encounter during the activity to the organiser to receive appropriate assistance. It is essential for participants to exercise caution, adhere to safety guidelines, and communicate openly to ensure a positive and enjoyable experience for everyone involved.

13.5 PhotographyBoundless Life may capture photographs or videos (“the Images”) during experiences, activities, ECA’s or services for promotional purposes. The usage of the images shall be made according to the applicable data protection regulation.

14. NON-SOLICITATION AND NON-COMPETITION
i. Client is not permitted to solicit .direct or indirectly, Boundless Life employees for business or personal gain. The Client may not use their stay in the Cohort for business purposes. The Client shall not offer or propose business opportunities to Boundless Life’s employees or other participants, this includes, but is not limited to, business ventures, investments  or any form of direct or indirect solicitation that could disrupt the community's harmony or interfere with the employment relationship between Boundless Life and its employees.. For the avoidance of doubt, Boundless Life shall not be involved in, nor bear any responsibility for, any matters arising from or related to the foregoing.

ii. Client is expected to maintain a respectful tone when discussing Boundless Life, its employees, other  Boundless Life’s Clients  or Boundless Life’s partners or providers. Derogatory language, or any form of disrespect towards Boundless Life’s employees, or other Clients is strictly prohibited. Boundless may take legal action in the event of defamatory acts, slander, and libel against Boundless Life.

iii. The unique experiences, information, and knowledge gained through participation in Boundless Life are proprietary and constitute confidential information. Client agrees not to use this information to replicate or create a competing product or service. This includes, but is not limited to, the concept, operational model, community engagement strategies, and any other aspects that are intrinsic to the Boundless Life experience.

iv. You also agree not to solicit or collect information about any of our Clients, especially for the purposes of: transmitting, or facilitating transmission of unsolicited or bulk electronic email or communications; promoting commercial activities (except as agreed to in writing by Boundless Life); advertising products or services, or engage in political lobbying.

1‍5. EVENTS OUT OF CONTROL OF THE PARTIES
i. Force Majeure: An event beyond the reasonable control of the parties to these Terms is referred to below as a “Force Majeure Event” and shall include such events as an act of God, fire, flood, storm, war, riot, civil unrest, act of terrorism, strikes,, outbreak of epidemic or pandemic of disease, failure of utility service or transportation.

ii. Notification: If either party to these Terms is prevented from or delayed in carrying out its obligations under these Terms by a Force Majeure Event, that party shall immediately notify the other in writing and shall be excused from performing those obligations while the Force Majeure Event continues.

iii. Continued Force Majeure: If a Force Majeure Event continues for a period greater than ninety  (90) days, the party who has provided notification shall notify the other of the steps to be taken to ensure the performance of this agreement if possible.

iv. Liability: Boundless Life shall not be held liable for any failure or delay in the performance of its obligations under these Terms due to force majeure. Moreover, and out of the force majeure events, except where Boundless Life is found to be grossly negligent or fraud causing personal injury, loss or damage, Boundless Life shall not be responsible to the Client or any third party, for any personal injury suffered, or damage to or loss of any property belongings. Boundless Life cannot be responsible for any personal injury and/or loss or damage suffered.

‍16. BREACH OF TERMS

In the event of a breach of any Terms by the Client, if the breach is remediable and has not been remedied within 10 days following receipt of written notice thereof from Boundless Life, Boundless Life shall be entitled to terminate the agreement with legal consequences and remedies that shall include, but not be limited to:

• Eviction without prior notice due to outstanding charges, plus an eviction penalty fee of €399.
• Claim for the damages that may have been caused plus immediate Education Centre dismissal.
• Denial of entry to Boundless Life facilities.In cases of material breaches that are not remediable, Boundless Life may immediately terminate the agreement and end the Client’s participation in the Cohort without providing any reimbursement, without prejudice to pursuing any legal action and claiming damages arising from the breach."Breaches of the Code of Conduct and any termination rights arising therefrom shall be governed by the provisions set forth in the Code of Conduct.

17. LIABILITY

17.1 The Client acknowledges and agrees that the Client is solely responsible for the acts or omissions of the other Family Members, including minors, as well as any other persons who may be present in the Boundless Life Home or are under the Client’s care. 

17.2 The Client, spouse or legal guardian shall be fully responsible for the actions or omissions of the minor, including any civil liability arising from such actions or omissions. This responsibility extends to any damages, losses, or injuries caused by the minor, and the Client, spouse or legal guardian agrees to indemnify and hold harmless Boundless Life from any claims or actions resulting from the minor's conduct.

17.3 If the Client is booking the Cohort  on behalf of other  participants of the Cohort, the Client will ensure, and the Client represents and warrants, that each  participant on whose behalf the Client books the  Cohort, or who is staying or visiting the Boundless Home during the Client’s stay at the Boundless Home has read and agreed to these Terms, which shall apply to each of them as if the reference to “the Client” was a reference to him/her.

17.4 The Client understands that the effect of these Terms is that the Client is releasing liability and waiving the Client’s right to sue and the Client is assuming risk for matters resulting from, arising out of or relating in any way to the Client’s rental and stay at Boundless Life Home , including but not limited to personal injury, death and property damage. 

17.5 The Client acknowledges that these Terms apply even if Boundless Life may be negligent in whole or in part except in cases of wilful misconduct or gross negligence. 

18. APPLICABLE LAW

These Terms shall be governed by and construed in accordance with Canadian law. If you act as a consumer and the applicable mandatory consumer protection laws in your country of residence contain more favorable provisions, these will apply regardless of the choice of Canadian law.
